Senators file grievance against Heatley

OTTAWA - The current battle between Ottawa Senators owner Eugene Melnyk and superstar Dany Heatley could set the emotional level for the National Hockey League's next round of contract talks.

The NHL has served the NHL Players' Association a grievance over a $4-million US signing bonus Melnyk had to pay Heatley on July 1 after the disgruntled forward refused a trade to the Edmonton Oilers.

Melnyk wants his money back. He thinks Heatley should have accepted the trade.

Heatley, who demanded a trade, had a no-movement clause in his contract, which did give him the right to veto a trade. Melnyk might be stuck by the very contract he approved for Heatley.

However, at the time the possibility of a grievance was first raised in early July, NHL deputy commissioner Bill Daly said there are "strong grounds upon which a claim can be pursued. The Ottawa franchise believes it has been damaged."

It certainly didn't help the Senators to have the Heatley affair hanging over their heads all summer because the uncertainty slowed ticket sales.

Whether Milan Michalek and Jonathan Cheechoo, the players the Senators received from the San Jose Sharks in the eventual trade for Heatley, are better or worse attractions than the players the Senators would have received from the Oilers - Andrew Cogliano, Dustin Penner and Ladislav Smid - is another question.

Heatley seemed unperturbed about the grievance. Approached by a reporter from the San Jose Mercury News after practice Tuesday, Heatley said he was "focused on hockey" and declined to comment.

A complicating factor is that this dispute may draw other teams into its orbit. There were plenty of rumours of attempted side deals involving other teams as the Heatley trade talks dragged on all summer. They could conceivably result in charges of tampering.

If getting the answers to those questions becomes part of the grievance process, there could be some considerable discomfort.

Senators general manager Bryan Murray maintains that Heatley's agents granted permission to speak to the Oilers, but then reneged once the deal was made.

"They implied that I didn't have permission to speak with Edmonton," Murray said.

"Three times on the weekend I told them that I was talking to Edmonton and I asked them if I could continue talking. They said that, yes, I could."

Whether there was interference to prompt the Heatley camp to renege will be a question the Senators will want answered.

How, or even when, this dispute will play out is anyone's guess. No one was tipping his hand after the news of the grievance, which was filed last summer, leaked on Tuesday.

The league and the NHLPA confirmed that the grievance had been filed, but wouldn't comment further. Melnyk and Murray weren't commenting, saying the matter was now in the hands of the league.

And neither of Heatley's agents, J.P. Barry and Stacey McAlpine, immediately returned phone messages.

While never closing the door on a grievance during the summer, Melnyk sounded as if he didn't have a lot of hope of ever seeing his $4 million again.

"When I do a deal on a napkin or a handshake or a 150-page document, it doesn't matter," he said during a July interview on The Fan 590 in Toronto. "I stick by my word, I stick by my signature, I stick by my handshake, and you go ahead and do it, and you expect the other side to be there because you've done your side of the bargain.

"You just bite your tongue and you sign the cheque, and let it play out."

The filing of a grievance doesn't mean the two sides can't settle on their own, but with the NHLPA set to defend Heatley's interests, it looks as if this will end up on the plate of an impartial arbitrator.

When it might reach that stage wasn't clear on Tuesday.

Melnyk should publicly concentrate on restoring what's left of this season and turn it around. Pursue the bucks in your own time. A case of misplaced priorities, big time!

good for Melnyk......it was Heatley who wanted the "no trade" claus in his contract.....we should sue him for breach....plus the signing bonus....what a joke!!

What a load of garbage. Denis would you turn away 4 million. I don't think so. The Senators owed it to Heatley. Just because the Sens suck again Ottawa has to go public with more garbage. Maybe they should have made sure Heatley would waive his NTC before they opened their mouths about the trade.

Good for you Rob !! Just a note Denis, every pro hockey player is there for the money. OMG, are you serious ?! Melnyk is making the Ottawa Senators go down hard because he can't make a decision to get rid of the right people. We lost Heatley based on some of those bad decisions. Heatley deserves every cent and Mr Melnyk and Brian should wake up !!! I cannot wait to see the game when Ray Emery is in goals. Ha Ha Ha ha ha LOVE IT !!!!

It seems to me that the Senators have an incredible PR department. Not only did they do a fine job of making Havlat seem selfish, but also Hossa and now Heatley...even after the Senators shot themselves in the foot and made the trade demand public. All the while, the public has always stayed onside with the team. There must be very strong reasons as to why these top tier players are not happy in Ottawa and I cannot believe that it is pure selfishness as the Senator organization would want us to believe. This is a time when Murray should be relieved and Nonis should be given the reins.

History shows...get your facts straight...Havlat wanted to re-sign in Ottawa, the guy loves the city...he owns a sick pad by the Marshes golf course in Kanata. Hossa signed to stay on but the sens wanted Dany instead. So quit sayin that players wanted to leave. Dany left because he wanted to live the highlife in Cali. But i will agree with you that their PR dept is a pure joke!

Psychology 101 - you present hearsay as if it is fact. But it's not, and any semi-intelligent person can see through your pathetic attempts to paint the Sens in a bad colour. It is blatantly obvious that Heatley's camp leaked the trade request - the Sens had nothing to gain from doing so. Use your head, people! Hossa was a hold-out and had to go - look at him bounce around the league since, bringing nobody anything except for his baggage. No way Havlat was worth $6 million, and even Chicago turned their back on him. Heatley is the King of all the Queens they have had to deal with. Hope Melnyk gets his money back and it sends a much needed message to all the prima donas out there playing games with their contracts...

It's kind of like what HISTORY SHOWS and COLLINGWOOD have said... These high-profile players are treated like garbage by the fans because of what the organization has said. Look at Heatley's conduct, though. He didn't badmouth the organization or anything. Whether people like or dislike him, he was professional about it. The Senators organization was not. He deserves the money.

Melnyk grasping at straws as there is no chance in hell that Heatley will be forced to return any portion of the balloon payment. Any player can ask for a trade and if he has a NTC/NMC he can accept or reject any trade. Sorry but that's the contract the organization offered him. What needs to be said is that Heatley DID NOT BREACH his contract. While it can be argued it was un-gentlemanly, it was not a breach to ask for a trade. Had he refused to report to camp, he would have been in breach and the Sens would have an argument. By all accounts, Heatley said he was going to report and fulfill his contract. Sorry Melnyk, you lose. Nice try though loser.

Sens fans treated Heatley like royalty until he pulled this suck attack, reneged on his contract, kept his bonus money anyway and never once even explained his selfish stance - because he couldn't. This is not professionalism, and he has no integrity whatsoever. You have to be a fool to believe the Sens wanted this to happen (let alone leaking this info) and they managed the best they could given the unfair position that idiot put them in. Dany has million dollar hands, but a 10 cent head - what's your excuse?

Can everyone stop saying it was bonus money? It was a balloon payment of his salary. Also, he didn't breach his contract. He trained in the offseason and said he would report to camp. Can we maintain a little perspective and get rid of the homerish attitudes?

Sens never put Dany down...that was the annoying media hyping everything so they could write something during the usual boring offseason. Im a huge Sens fan and I dont blame Dany for his decision, however i dont like it but he had every right to demand a trade. Either way everyone is better off now.

Look up "bad faith" under Contract Law. There is a very real case for demanding that money back - I won't hold my breath, but I hope Melnyk wins. Sends a postitive message to these d-bags...

The signing bonus is just icing on the cake for Dany - and it's rightfully his because he's still playing under the same contract, just a different team.

This one should be interesting when it plays out in the courts. Yes it was in Heatleys contract that he is entitled to this bonus, but is it not also in his contract that he had a no trade clause and was expected to play for Ottawa? I am not a lawyer but it seems to me that Heatley violated the "spirit of the law." As far as I am concerned, the minute Heatley decided to punk out on the Senators and get out of his contract, it should become null and void. This is clearly not the case but it would send a message to punks like Heatley that they have to live up to their end of these one sided contracts. Hard to believe Ottawa had the bad fortune to have Heatley and Yashin in their organization. I hope the Senators get the ruling on this one.

You might want to look it up considering we're talking about the OFF SEASON. All he has to do is keep in shape and report to camp. If the Sens are going to claim an anticipatory breach, good luck. That is the hardest thing to prove in contract law. Also, since he said he would report to camp, how could there be an anticipatory breach?

Seriously, this is a sports contract - can't compare it to other industries. A player is under long term contract with a negotiated no-trade clause. He vetos the only trade they can put together to accomodate him. He says he will "show up" to training camp if he has to. This is clearly not good faith, which is the underlying basis for any sports contract. Is the evidence enough to win in court - maybe not. But it is definitely a fight worth taking on, and I credit Melnyk for having the balls to take on this weasel.

The horse is out of the barn. The time to battle in court was this past summer. Melnyk could have asked Heately for a committment as to whether he intended to honour his contract. If no, then take the matter to court at that time os subsequently. Now, the Sens have traded Heately and he is no longer under contract with the Sens. Any dealings, between the parties, before the trade is no longer of any consquence since Ottawa did not raise the issue at the appropriate time.Once the Sens "signed off" on the trade they "sealed their fate". It's now, "crying over spilled milk".

The timing of this grievance is irrelevant. It did not serve the Sens best interests to have this fight while trying to deal the guy - think about it. Now that the dust has settled, time to get it on. On another point, perhaps the reason Mr. Heatley did not badmouth the Sens on his way out was because there was nothing bad he could say. They treated him like royalty other than the requirement to WORK each game. What possible gripe could he have that wouldn't make himself look even worse than he already does?

I think most GM's are short on couple of cells in the matter of brain power. They can't walk away from a deal , even it its a bad one.Heatly got fat long term contract, and he even got a No Trade clause. He kept up his part of the deal, and the contract. Only that he plays for the Sharks. I am not a fan o his, but Murray could not come up with a viable trade, to off set the asset loss that went to the Sharks. Melnyk you loose. Had the Senators got Joe Thorton, they would not be crying for the $4.ooo. They just happen toget a bag of pucks in the trade, so to speak. In the meantime Heatly may still be a jerk, but rich one.

Well it is the old closing the barn now that the horse has bolted. Now let's get down to it. If the player asks for a no trade contract, he is not asking because he just loves it here and will not go anywhere else. He wants it for leverage. If you are dumb enough to go along with this idiocy, history has shown it will blow up in your face if things start to sour. Now look at the mess the Sens are in with this. Now it has to go to the league for futher comment. What a joke! If he had a regular contract and if things did not work out you could have traded him and avoided this whole mess. If you are management and you give up this power you only have yourselves to blame.....

How the heck do you figure Heatley lived up to his part of the deal? Give yer head a shake, man. The deal he had for three of your players was a good one for the Sens, in fact. And although Cheechoo has been a disappointment, Sens fans couldn't be happier with Michalek - this gem of a 2-way player is anything but a bag of pucks. A lot of us actually like the TEAM a lot better without ol whatsisname...

Heatley wanted out and he asked for a trade, not different than you or I would do if we were unhappy. Contract is a contract, regardless and he's entitled to his money. You may not like how it happened but there are a lot of bottom feeders to be paid here. The managers (two), the tax department, the cost of the move and then there's the lifestyle. 4 million isn't a lot of dough and I'm sure he needed it. Bottom line, Melnyk agreed to give it to him and he should stop airing his dirty laundry in public, learn his lesson about loose contracts and realized he's been had and move on.
